Securing India’s National ID Database

As India integrates its National ID database to its government, financial, social, healthcare, and other systems, there are growing concerns that the Aadhar ID ecosystem is not equipped to identify and authenticate any individual, nor is it designed to certify the process of delivery of subsidies, benefits, and services.

The reports are emerging that the identity databases are full of fraudulent and duplicate identities, and as a result, the benefits, rights, and entitlements do not reach the rightful owners and many Indians have been denied the benefits by declaring them as non-existent.

The questions are emerging whether India has put together robust security, legal and regulatory framework to secure the national ID database and its ecosystem as multiple security breaches have reportedly compromised the records of all 1.1 billion registered citizens according to the World Economic Forum’s (WEF) Global Risks Report 2019.

As concerns grow about the lax security protocols, and data security vulnerabilities of India’s National ID database, the mandatory linkage of the Aadhar ID to nations financial, government, and other systems is becoming a cause of great concern as it fundamentally threatens governance, financial, security, rule of law and the very promise of justice, equality, liberty and dignity made by the constitution.

About the Guest

Dr. Subhajit Basu is an Associate Professor of Information Technology Law. His focus area of research is on the regulation of the internet, including issues relating to privacy, data protection, freedom of expression, and e-commerce. He is also the Chair of the British, Irish Law Education and Technology Association (BILETA). He holds a Ph.D. from Liverpool John Moore’s University and an LLB from the University College of Law, Faculty of Law, Calcutta University. He was called to the Bar in 1998 and worked as an Advocate specializing in Corporate Law in India.

He aims to explore the challenges that the Internet has created in transforming our lives, especially in the area of governance and in our legal framework. Understanding and making sense of the increasing amount of “data” that is out there is central to his research. “Big data” can control our lives, and he is particularly interested in how we can better inform and empower consumers. He is also keen to examine how we can update our legal framework to protect the privacy and equip the public with the knowledge needed to make informed choices.
