Vicky Shah, an Advocate, Author, Speaker, Legal Advisor, and Trainer to Police Officers in India for Cyber Crime Investigation participates in Risk Roundup to discuss Biometric Identification and Privacy law.

Overview

Biometrics is taking over traditional identity practices and is now commonly accepted as a proven way of identification and authentication by nations and all its components. There are reports emerging that biometrics practices are already been implemented on a national level for its national identity applications. So, as nations begin applying biometric technology for managing identity, the question arises as to what is at risk and who is at risk.

The reason behind that is biometrics technology is also a “very powerful enabler” of mass surveillance. And just like any other technology and system, the biometrics system also has its own limitations. Now when any implementation of biometric technology, (like the Biometric ID card project Aadhaar Act implemented in India) links almost every part of a citizen’s personal life to a central nation/state database, it raises serious concerns about whether there is an adequate legal framework for protecting citizens’ privacy and security rights. It is important to understand and evaluate:

  • What are the risks of using biometrics for national id?
  • How secure is the data that is being collected?
  • Is the data infrastructure putting user privacy at risk?
  • Are there robust laws to protect data of citizens?

Time is now to discuss Biometric Identification and Privacy Law!
